Terms of Service

Scope and acceptance

These terms of service (the “Terms”) govern access to and use of the website teacher-and-me.com and the application it hosts (together, the “Service”), published by Mathieu Soysal (the “Publisher”, see the legal notice).

You accept the Terms when you create your account (a reminder appears on the sign-in page) and every time you use the Service. If you do not accept them, do not use the Service. The Service is free of charge (see “Free of charge and donations”).

The Terms are written in French; only the French version is binding. This English version is provided for information only.

Definitions

• User: anyone who holds an account on the Service.
• Tutor: a User who, in the “teacher” role, creates Paths and enrols Students on them.
• Student: a User who, in the “student” role, follows the Paths they are enrolled on.
• Path: a set of lessons and interactive exercises created by a Tutor.
• Content: everything a User creates or enters in the Service: paths, lessons, exercises, audio clips, messages, answers, reviews and comments.
• Catalogue: the public area of the Service where a Tutor can publish a Path for other Users.

The Service

The Service lets a Tutor create Paths of interactive exercises, enrol their Students, follow their progress exercise by exercise and send them messages; lets a Student follow those Paths, including offline, and see their results; and lets a Tutor publish a Path in the Catalogue and query an assistant based on artificial intelligence (see “Assistant”). The Service evolves continuously: features may be added, changed or removed.

Account

Accounts are created and opened on the sign-in page, with a code sent by e-mail, a Google account or a passkey. One account corresponds to one e-mail address. You must own the address you use: on the first e-mail sign-in, the account is created immediately for the address entered, and code verification applies from the next sign-in on.

The role (teacher or student) is chosen at sign-in and can be changed at any time; creating and editing Paths is reserved to the “teacher” role. You undertake to give accurate information, to keep control of your e-mail address, your Google account and your passkeys, and to tell us without delay of any unauthorised use of your account. You are responsible for the activity carried out from your account.

Age requirements

The “teacher” role is reserved to adults. Students may be minors. A Tutor who enrols a Student under 15 confirms that they hold the authorisation of the holder of parental responsibility and undertakes to produce it on request. The Service collects no age data and does not verify these statements: they bind whoever makes them.

Tutors’ undertakings

When you use the Service in the “teacher” role, you undertake to:

• enrol only Students who have asked you, or whose legal guardians have asked you, to follow your lessons, and tell them that their progress and answers are visible to you;
• be answerable for the lawfulness of the data you enter about your Students (e-mail addresses, answers, messages, availability) under the rules that apply to your activity, including the parental authorisation mentioned above, and use your Students’ e-mail addresses and names only for your teaching;
• enter in the Service only the data strictly needed for teaching follow-up, and no sensitive data (health, origin, opinions, and so on);
• hold the necessary rights over all the Content you create or upload (texts, audio clips, linked videos, images), or have a permission or a legal exception;
• publish in the Catalogue only Paths you authored or whose public distribution rights you hold.

Students

A Student is enrolled on a Path by the Tutor who created it, from their e-mail address. That Tutor then sees the Student’s progress, answers, declared availability and exam goal on that Path, and can send them messages. A Student can erase their progress, delete the messages they received and delete their account at any time; only the Tutor can remove them from a Path.

Content, ownership and licence

You remain the owner of the Content you create. So that the Service can work, you grant the Publisher a non-exclusive, worldwide, royalty-free licence, for as long as your Content is hosted, to store it, reproduce it, adapt it technically (formats, previews, offline copies) and display it:

• to the Students enrolled on your Paths and, for your messages, to their recipients;
• publicly, only for the Paths you publish in the Catalogue, with your name unless you enabled “hide my profile”, including on the Catalogue’s public pages, which are regenerated regularly;
• to the assistant, in anonymised form, when you query it.

You end this licence by deleting the Content or your account: the Content disappears from the Service, and from the Catalogue’s public pages within 24 hours. Offline copies already stored on your Students’ devices cannot be recalled.

The Publisher does not review Content in advance. It may remove or hide, without notice, any Content reported to it that is manifestly illegal or contrary to the Terms (see the reporting procedure in the legal notice; Paths in the Catalogue can also be reported from within the application), and suspend its author’s account (see “Term and termination”).

Students keep their rights over their answers; those are visible only to themselves and their Tutor and, in anonymised form, to the assistant when the Tutor queries it.

Assistant

The assistant is reserved to Tutors. Its answers are produced by artificial-intelligence models (@cf/mistralai/mistral-small-3.1-24b-instruct, then @cf/meta/llama-3.1-8b-instruct-fast) and may be inaccurate, incomplete or unsuitable: they are suggestions that you check before relying on them. A change to a Path suggested by the assistant is only applied if you expressly approve it. Usage limits (requests and tokens per period) apply. Your Students’ names are anonymised before anything is sent; the privacy policy describes precisely what is sent and kept. The Publisher may change, limit or withdraw the assistant at any time.

Prohibited uses

You may not use the Service to:

• publish or transmit Content that is illegal, defamatory, hateful, harassing, sexual, or that infringes third-party rights (copyright, trademarks, privacy, image rights);
• collect data about other Users, enrol people without their agreement, impersonate anyone or create accounts on e-mail addresses you do not own;
• disrupt the Service, circumvent its usage limits or security mechanisms, access it through unauthorised automated means, or attempt to access other Users’ data;
• reproduce, copy or extract the Service, its pages or its Content, including to train or feed artificial-intelligence systems, outside the terms published at teacher-and-me.com/llms.txt;
• use the Service for commercial purposes other than your own teaching activity (resale, prospecting, advertising).

Availability, changes and backups

The Service is provided “as is” and is available continuously, except for maintenance, outages, force majeure or a provider’s failure. The Publisher guarantees no level of availability. The application keeps offline copies on your device; the databases have technical restore points for 30 days. It is up to you to export the data you care about (Settings → download my data; per-student CSV exports for Tutors).

The Publisher may develop the Service, change or remove features and, if need be, discontinue it, announcing it on the Service with reasonable notice so that you can export your data.

Free of charge and donations

The Service is free and has no paid plan. You can support it with a voluntary donation on the Ko-fi platform (Ko-fi Labs Limited, United Kingdom) at ko-fi.com/teacher_and_me. Donations are collected by Ko-fi under its own terms; the Publisher receives no payment data. A donation grants no right and no additional feature.

The Publisher’s intellectual property

The Service, its code, design, texts, illustrations, logo and the name “Teacher and Me” belong to the Publisher. The Terms only grant you a personal, non-exclusive and non-transferable right to use the Service for its intended purpose. The terms that apply to crawlers and artificial-intelligence tools are published at teacher-and-me.com/llms.txt.

Liability

The Service is provided free of charge, by a natural person on a non-professional basis, with the reasonable means of such a project. The Publisher is not liable for Content published by Users, for the accuracy of the assistant’s answers, for the third-party sites the Service links to, or for indirect damage (loss of data that was not exported, loss of opportunity, damage to reputation) arising from the use or unavailability of the Service.

Each User is responsible for their use of the Service, their Content and compliance with the rules that apply to their teaching activity. Nothing in the Terms excludes or limits a liability that cannot be excluded by law, or the rights the law of your country of residence grants you as a consumer.

Term and termination

The Terms apply for as long as you use the Service. You can delete your account at any time (Settings → delete my account): deletion is immediate and its effects are described in the privacy policy.

The Publisher may suspend or delete an account that breaches the Terms, after informing you by e-mail where possible, and without notice in serious cases (illegal Content, harm to the security of the Service or to other Users).

Personal data

The processing of personal data linked to the Service is described in the privacy policy, which forms part of the Terms.

Changes to the Terms

The Publisher may change the Terms. The version in force is the one published at this address, with its date and version number. Significant changes are announced on the Service; continuing to use the Service after they take effect means you accept them. If you refuse them, you can delete your account.

Governing law and disputes

The Terms are governed by French law. If a problem arises, write first to contact@teacher-and-me.com: we will look for an amicable solution. Failing that, the competent courts are those designated by law; if you are a consumer, you keep the protection of the mandatory rules and courts of your country of residence.
